I don't think he can legally make you work overtime when you have a doctors note that you cannot work. You should contact a employment lawyer, because I'm sure you have several options that you can look into. You should be able to have the time you need to recover before going to full or over time work. (removed)
The question
Today I returned to work after having surgery. I was told by my supervisor if I was not able to work overtime then he did not want me at the office at all. I never went on STD as I have been answering emails and taking phone calls from home thus I have been receiving my full salary since the surgery (05/13/13).
I had a doctor's release to allow me to return for 40 hours a week. My doctor jhas now given me another note stating I could not return until July 1st if I am expected to work 60 -70 hours a week.
IBTW we also allow our hourly employees ( male truck drivers) to work in the office during their limited duty work. I am a female and my supervisor is in Canada but I am a US citizen working in the US.
Can he legally do that? Are there any laws that limit how many hours an employer can request a person to work a week?
